These Terms of Use ("Terms") govern your use of the Breathr: Quit Smoking mobile application ("Breathr", the "app"), published by NFT Atoms ("we", "us", "our"). By downloading or using Breathr, you agree to these Terms. If you do not agree, do not use the app.
1. What Breathr is (and is not)
Breathr provides motivational content, breathing exercises, progress tracking, and educational information to support you in quitting smoking. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified health professional about quitting smoking, nicotine withdrawal, or any health condition. Never disregard professional medical advice because of something you read in this app.
2. Subscriptions & auto-renewal
Breathr Pro is a yearly auto-renewing subscription with a 3-day free trial. Key terms:
- Payment is charged to your Apple ID or Google account at the end of the free trial unless you cancel at least 24 hours before the trial ends.
- The subscription renews automatically each year at the price shown at the time of purchase until you cancel.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription anytime in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple or Google under their respective store policies; we do not directly process payments or refunds.

3. Licence
We grant you a personal, non-exclusive, non-transferable licence to use Breathr on devices you own for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, or redistribute the app or its content.
4. Your responsibility
Quitting smoking is your decision and your responsibility. Progress statistics, health-recovery timelines, and savings estimates shown in the app are general, evidence-informed approximations — your individual results will vary.
5. Disclaimer of warranties
Breathr is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free.
6. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim.
7. Apple & Google app stores
If you obtained Breathr from the Apple App Store, you acknowledge that these Terms are between you and NFT Atoms only, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. To the extent Apple's standard Licensed Application End User License Agreement (apple.com/legal/…/stdeula) applies, these Terms supplement it, and any conflict is resolved in favour of the more protective consumer term. Similar acknowledgements apply to Google for apps obtained from Google Play.
8. Changes
We may update these Terms as the app evolves. Material changes will be reflected in the "Last updated" date above; continuing to use the app after a change means you accept the updated Terms.
