These Terms of Use ("Terms") govern your use of the Habit Builder mobile application (the "App") provided by NFT Atoms ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms and the rules of the app store you downloaded it from.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App. By using it, you represent that you meet this requirement.
3. Subscriptions and purchases
- The App offers optional paid features via an auto-renewing subscription and/or a one-time lifetime purchase ("Premium").
- Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
- Auto-renewal: subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
- Managing & cancelling: you can manage or cancel your subscription in your Apple App Store or Google Play account settings after purchase. Deleting the App does not cancel a subscription.
- Refunds are handled by Apple or Google under their policies; we generally cannot issue refunds directly.
- Prices may change; we will not change the price of an active subscription period without notice as required by the app stores.
4. Advertising and rewards
The free version of the App offers optional rewarded ads you may choose to watch to unlock certain features temporarily. Rewards are provided on a best-effort basis and depend on ad availability. We are not responsible for the content of third-party ads. Premium removes ads.
5. Acceptable use
You agree not to: (a) reverse engineer, decompile, or tamper with the App except as permitted by law; (b) use the App for any unlawful purpose; (c) attempt to gain unauthorized rewards, purchases, or features; or (d) interfere with the App's security or normal operation.
6. Health, wellness, and financial disclaimer
Habit Builder is a self-improvement and productivity tool. Any wellness, health, longevity, or "estimated" figures shown are for motivation only and are not medical advice. Any monetary or investment-style projections are illustrative only and arenot financial advice. Always consult a qualified professional before making health or financial decisions.
7. Intellectual property
The App, including its design, text, graphics, and logos, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will meet your requirements.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim.
10. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Nothing in these Terms limits any consumer rights you may have that cannot be waived under local law.
13. Apple App Store
If you downloaded the App from the Apple App Store: these Terms are between you and NFT Atoms only, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use of the App must also comply with Apple's applicable terms, including the Licensed Application End User License Agreement (EULA).
